Terms of Service for wildcard dex

1. Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and Play Outside Games ("we", "us", or "our") for your use of the wildcard dex mobile application ("the app") and the wildcarddex.com website (together, "the service"). By downloading, installing, or using the service, you agree to these Terms. If you do not agree, do not use the service.

If you use community features, you also agree to the Community Guidelines. Our Privacy Policy explains how we handle your information.

2. The Service

Wildcard dex lets you photograph wildlife and plants, identify species with AI, and collect them as cards in your dex. Optional community features let you share Finds with friends or the public, react to other players' Finds, show a public profile, join leaderboards, and offer photos to the Public Dex species guide.

We may add, change, pause, or remove features. Some features are available only in certain versions, regions, or test groups.

3. Who Can Use the Service

• The app is for general audiences. If you are under the age required to agree to these Terms where you live, a parent or guardian must agree to them for you
• Community features are only for people aged 16 and over. Before you use them, we ask you to confirm that you are 16 or older. You must answer truthfully
• If you are under 16, you can still use the solo collection game. Community features stay off for your account
• You may not use the service if we have previously removed you from it, unless we agree in writing

4. Your Account

• The app creates an anonymous account for you. You can sign in with Google or Apple to back up your dex and recover it on another device
• You are responsible for activity on your account and for keeping access to your sign-in provider secure
• Do not share, sell, or transfer your account, and do not create accounts to get around a restriction or suspension
• You can ask for a copy of your data or ask us to delete your account at any time by emailing support@wildcarddex.com, as described in the Privacy Policy

5. Community Features

• Each Find has an audience you choose: Only me, Friends, or Public. You can change the audience or delete a Find at any time
• Display names, handles, and profile pictures are visible to the audience you choose, or to everyone if your profile is public
• Joining the leaderboards shows your public profile and scores to other players. You can leave at any time
• Sharing a Find as Public can make its photo eligible to represent that species in the Public Dex. Offering a separate photo to the Public Dex is a separate choice for that photo only
• Shared content may be checked automatically and reviewed by people before or after it is shown

6. Your Content

"Your content" means the photos, cards, Finds, display names, profile pictures, and other material you add to the service.

• You keep ownership. Your photos and other content remain yours
• Private content. For content you keep private, you give us permission to store, process, and back it up only to provide the service to you, including AI identification
• Shared content. When you share content with friends or the public, or contribute it to the Public Dex, you give us a non-exclusive, worldwide, royalty-free license to host, store, copy, resize, re-encode, remove metadata from, display, and distribute that content within the app and on our website, to the audience you chose, for as long as it is shared. This license lets us operate the service. It does not let us sell your content
• No AI training. We do not use your shared content or Public Dex contributions to train or evaluate AI models
• Attribution. Public Finds are shown with your public profile. For a separate Public Dex contribution, you choose whether it is credited with your display name or shown as anonymous
• When the license ends. The license for a piece of content ends when you delete it, withdraw it, change its audience to Only me, or delete your account. We stop showing it right away. We may keep copies for a limited time where the Privacy Policy says so, for example in moderation records
• Your promises. You confirm that you took the photos you share or have the right to share them, and that your content follows these Terms and the Community Guidelines

7. Conduct

You agree to:

• Use the service only for lawful purposes
• Follow the Community Guidelines when you use community features
• Respect wildlife and habitats, and follow local laws and rules when photographing animals and plants

You agree not to:

• Post content that is illegal, sexual, hateful, threatening, harassing, or graphic, or that shares someone's personal information
• Share photos you did not take or do not have the right to share, or present fabricated or manipulated images as real observations
• Cheat, including manipulating scores, leaderboards, trades, or identifications, or using multiple accounts to gain an advantage
• Impersonate another person, player, or organization
• Send spam, advertising, or scams
• Reverse engineer, scrape, overload, or interfere with the service, or access data or accounts that are not yours
• Use the service to find, disturb, harm, or trade protected species

8. Reports, Moderation, and Enforcement

• You can report content or players and block other players in the app
• We may review, hide, restrict, or remove content, and limit, suspend, or remove accounts, when we believe content or behavior breaks these Terms or the Community Guidelines, creates risk for people or wildlife, or is required by law
• When we take an action that can be appealed, we tell you the decision and the reason, and you can appeal it once in the app
• We do not tell a player who reported them
• We are not required to monitor all content, and we are not responsible for content posted by other players

9. Intellectual Property

• The service, including the app, website, card designs, artwork, and species information we provide, is owned by Play Outside Games and is protected by law
• We give you a personal, non-transferable, revocable license to use the app on devices you own or control, under these Terms and the rules of the app store you downloaded it from
• Species information is provided for educational purposes
• If you believe content on the service infringes your copyright, contact us at the email below with the details

10. AI Identification

• Species identifications and species details are AI-generated and may be wrong
• Do not rely on the app to decide whether a plant, fungus, or animal is safe to touch, eat, or approach
• Consult experts for any identification that matters for health or safety

11. Safety Outdoors

You are responsible for your own safety and for following the law while using the app. Keep a safe distance from wildlife, do not enter private or closed land without permission, and pay attention to your surroundings.

12. Subscriptions and Payments

• Some features require a dex++ subscription
• Subscriptions are billed through the Apple App Store or Google Play and renew automatically until you cancel in your store account settings
• Refunds are handled by Apple or Google under their policies
• Purchases made in a test or sandbox environment, including TestFlight and Google Play test purchases, do not unlock dex++

13. Beta Versions

Beta versions of the app may contain errors, lose data, or change without notice. Features in a beta may never be released. We may end a beta at any time. Please send feedback to the email below or through our Discord.

14. Ending Your Use of the Service

• You can stop using the service at any time. You can ask us to delete your account by emailing support@wildcarddex.com
• We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the service. Where reasonable, we will tell you why
• When your account is deleted, your shared content stops being shown and your data is handled as described in the Privacy Policy
• Sections 6 (for copies we may keep), 9, 10, 15, and 18 continue to apply after your use ends

15. Disclaimers and Limitation of Liability

• The service is provided "as is" and "as available", without warranties of any kind, to the extent allowed by law
• We do not guarantee that identifications are accurate, that the service will always be available, or that data will never be lost
• To the extent allowed by law, we are not liable for indirect, incidental, or consequential damages, or for content posted by other players, arising from your use of the service
• Some places do not allow these limits. In those places, they apply only as far as the law allows. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived

16. Privacy

Your use of the service is also governed by our Privacy Policy.

17. Changes to These Terms

We may update these Terms. For material changes, we will update the date above and ask you to review and accept the new Terms in the app before you continue to use community features. If you do not agree to the updated Terms, stop using the service.
